Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Tryvio virtual try-on application ("Service"), operated by MiYoMi OOD (МиЙоМи ООД), UIC BG207348449, 26 Yantra St, Golyamo Vranovo, Slivo Pole, Ruse Region, Bulgaria ("we", "us", "our"). By installing or using the Service, you agree to these Terms. If you do not agree, do not install or use the Service.

2. Service Description

Tryvio is a Shopify application that enables virtual try-on experiences for shoppers of Shopify stores. It allows merchants to display AI-generated try-on images to their customers and provides analytics on try-on performance.

3. Eligibility

You must have a valid Shopify store and agree to Shopify's Partner Program Agreement to install the Service. You represent that you have the authority to bind yourself or your organization to these Terms.

4. Subscriptions and Billing

4.1 Free Trial

New merchants receive a 14-day free trial with up to 100 try-on generations (or 200 for qualified stores). No payment is required during the trial. If the trial limit or period expires, try-on generation is paused until a paid plan is activated.

4.2 Paid Plans

Paid plans are billed monthly through Shopify Billing. Current plans:

4.3 Overage Charges

Try-ons generated beyond the monthly plan limit are charged at the overage rate listed above, subject to a monthly cap. Overage charges are billed at the end of each billing period through Shopify Usage Charges.

4.4 Billing via Shopify

All payments are processed exclusively by Shopify through the Shopify Billing API. We do not collect, store, or process credit card or payment information. Your payment is governed by Shopify's Terms of Service and billing policies.

4.5 Cancellation

You may cancel your subscription at any time from within the Shopify Admin. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Upload photos that contain nudity, violence, hate speech, or any content that violates applicable laws.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Use the Service to generate content that infringes third-party intellectual property rights.
• Abuse the trial or overage systems through automated or fraudulent means.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate your access immediately if we detect a violation of this section.

6. AI-Generated Content

The try-on images produced by the Service are generated by artificial intelligence. We do not guarantee that generated images will be accurate, realistic, or suitable for any specific purpose. Generated images are intended as a visual aid for shoppers and should not be relied upon as a definitive representation of how a product will look.

You are responsible for ensuring that the use of AI-generated imagery on your store complies with applicable advertising and consumer protection laws.

7. Intellectual Property

Our IP: The Service, including its software, design, and underlying models, is the property of MiYoMi OOD. Nothing in these Terms grants you any ownership rights in the Service.

Your content: You retain ownership of any product images and other content you provide. By installing the Service, you grant us a limited licence to use your product images solely for the purpose of generating try-on results for your shoppers.

Shopper photos: Uploaded photos are used only to generate the try-on result and are deleted within 30 days. We do not claim ownership of shopper photos.

8. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service, you agree to our Privacy Policy.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, MiYoMi OOD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless MiYoMi OOD and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time with reasonable notice. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date above when changes are made.

13. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your data will be retained for 30 days then deleted per our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of the Republic of Bulgaria. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Bulgaria.
